Terms and Conditions (AGB)

§ 1 Scope

These General Terms and Conditions apply to all orders placed through the online shop omune.de operated by Duketable GmbH, Lauenburger Str. 1, D-65824 Schwalbach am Taunus. The version of the Terms and Conditions valid at the time of the order shall apply.

§ 2 Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order. By submitting your order, you make a binding purchase offer. Acceptance occurs through our order confirmation email or by delivery of the goods.

§ 3 Prices and Shipping Costs

All prices are final prices in euros and include the statutory value-added tax. Shipping costs are shown separately before the order is completed.

§ 4 Delivery

Delivery is made to the delivery address specified by the customer. The delivery time is usually 1–5 business days within Germany. Different delivery times are indicated on the respective product page.

§ 5 Payment

Payment is processed through the payment service provider Shopify Payments. We accept the payment methods displayed during the order process (e.g., credit card, PayPal, instant bank transfer, Apple Pay, Google Pay).

§ 6 Right of Withdrawal

As a consumer, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party designated by you took possession of the last goods.

To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g., by email or post):

To meet the withdrawal deadline, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the withdrawal period expires.

§ 7 Exclusion of Withdrawal for Food Products

The right of withdrawal does not apply to contracts for the delivery of goods that can spoil quickly or whose expiry date would be exceeded quickly (§ 312g para. 2 no. 2 BGB). The right of withdrawal is also excluded for sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

§ 8 Warranty

Statutory warranty rights apply. The warranty period is two years from receipt of the goods. For used goods, the warranty period may be reduced to one year.

§ 9 Limitation of Liability

We are liable without limitation for intent and gross negligence. In the case of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations), limited to the foreseeable, contract-typical damage. This limitation of liability does not apply in the event of injury to life, body, or health.

§ 10 Applicable Law

The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence is not withdrawn.

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
